Court dismisses Keith Schembri’s case against three Opposition MPs
For the Partit Nazzjonalista, this judgment confirms that its MPs were carrying out their duty of parliamentary scrutiny when, faced with conflicting sworn testimony, they asked the competent authority to investigate.
The Court has dismissed the claims brought by Keith Schembri in the constitutional case he filed against the Chair of the Public Accounts Committee, Darren Carabott, and Opposition MPs serving on the same parliamentary committee, David Agius and Graham Bencini, following their work on the PAC in connection with the investigation into the Electrogas contracts.
The case was filed after the three Opposition MPs submitted a report to the Commissioner of Police in April 2023, asking him to investigate conflicting versions of events given under oath, including those of Keith Schembri and Professor Edward Scicluna.
In its judgment, the Court rejected Keith Schembri’s claim that the actions of the three MPs had breached his fundamental rights. The Court also observed that their report did not determine who had given false testimony, but rather referred the conflicting versions to the Commissioner of Police for investigation.

What remains unanswered is what became of that request to the Commissioner of Police.
More than three years have passed since the Nationalist MPs submitted their report to the Commissioner of Police. The issue they raised was clear: where conflicting versions had been given under oath, it had to be established whether perjury had been committed and, if so, by whom.
The Partit Nazzjonalista is therefore once again calling on the Commissioner of Police to account for what action was taken on the report submitted in April 2023 and whether the investigation was carried out.
