Council of Europe echoes Partit Nazzjonalista’s concerns over human rights reform

Among other things, the Commissioner has called for greater independence from the Government in the appointment of members, so that the Commission can carry out its duties in accordance with international standards. This is essential to ensuring that the Commission can operate effectively, including when it is required to scrutinise the Government itself.

Calls on the Government to listen, consult and improve the legislation to ensure that the National Commission for Human Rights and Equality is truly independent and effective

The Council of Europe, through its Commissioner for Human Rights, has echoed the concerns and position expressed by the Partit Nazzjonalista, stating that the reform concerning the National Commission for Human Rights and Equality requires substantial improvements and meaningful consultation.

The Partit Nazzjonalista has long insisted that this reform is far too important for the Government to attempt to rush it through without proper consultation.

Among other things, the Commissioner has called for greater independence from the Government in the appointment of members, so that the Commission can carry out its duties in accordance with international standards. This is essential to ensuring that the Commission can operate effectively, including when it is required to scrutinise the Government itself.

The Partit Nazzjonalista had already raised these same concerns about the reform in Parliament. However, the Government failed to listen and pressed ahead without consultation.

Over the past few months, the Opposition has been consulting various NGOs and has held several meetings involving experts in the field. The Partit Nazzjonalista remains committed to broad dialogue to ensure that Parliament legislates in the best interests of the people. The PN has consistently insisted, and continues to insist, that Malta must have a strong, independent institution capable of defending everyone’s rights.

The fact that the Government is now indicating that it is reconsidering certain aspects of the Bill demonstrates just how necessary the calls for improvements were. The Government must now publish its proposed changes and discuss them with the Opposition and civil society before presenting them to Parliament.

The Partit Nazzjonalista will continue working towards a reform that provides people with genuine protection and strengthens public trust in institutions.

Human rights deserve an institution that is free and independent, and that stands up for their protection.
