Responsibility for the revocation of garnishee orders on Keith Schembri and his wife due to negligence lies squarely with the Attorney General

What has happened is a serious failure in the administration of justice in our country and raises questions as to whether the authorities whose duty it is to safeguard justice are applying different standards depending on who is involved.

The Court has revoked garnishee orders against Keith Schembri’s Kasco Holdings and Josette Schembri Vella because the responsible authorities failed to renew them on time. Full responsibility for this lies at the door of the Attorney General.

What has happened is a serious failure in the administration of justice in our country and raises questions as to whether the authorities whose duty it is to safeguard justice are applying different standards depending on who is involved.

The Attorney General must immediately explain how such important freezing orders were allowed to expire, and must clarify whether this was a grave failure of competence or whether it happened by design. In a case such as this, the Attorney General has an obligation to give a clear account to the Maltese and Gozitan people.

In a serious country, the authorities responsible for safeguarding justice carry out their duties with rigour, and cases involving alleged corruption, money laundering and financial crime are handled with the utmost competence. The fact that the authorities “forgot” to renew garnishee orders can never be accepted as evidence of competence or seriousness. It raises serious doubts about those in positions of responsibility who are supposed to ensure that justice is done, and is seen to be done, equally with everyone.

The Opposition will continue working so that the people can have peace of mind that the justice system is truly fair, and does not favour those connected to power by allowing room for mistakes from which the privileged few may benefit.

There is no place in any country for one law for the gods and another for the animals. Those who allow this to happen do not have the competence required to hold offices that are meant to guarantee that the law applies equally to everyone.
